TURKISH GET UP — MASTER LEGAL AGREEMENT

(Informed Consent, Liability Waiver, Assumption of Risk, Privacy Acknowledgment, Arbitration Agreement, and Release of Claims)

For Adults and Minors (U.S. & California Compliant)

1. INTRODUCTION AND PURPOSE

This Master Legal Agreement ("Agreement") governs participation in all fitness assessments, evaluations, exercise programs, wellness services, training sessions, digital content, and related activities provided by Turkish Get Up, LLC ("Turkish Get Up," "TGU," "we," "us," "our").

This Agreement applies to:

• All adult participants (18+)
• All minor participants (under 18)
• All parents or legal guardians signing on behalf of minors

By signing or electronically accepting this Agreement, the Participant (or the Parent/Guardian of a minor) acknowledges understanding and acceptance of all terms herein.

2. PARTICIPATION IS VOLUNTARY

Participation in any fitness or wellness activity through Turkish Get Up is entirely voluntary.

You (or your minor child) may withdraw at any time, decline any activity, or refuse any exercise without penalty.

3. INFORMED CONSENT

Turkish Get Up provides fitness assessments, movement screens, educational material, and individualized exercise programming. These services:

• Do not diagnose medical conditions
• Are not physical therapy or medical treatment
• Do not replace advice from a licensed healthcare provider

Participants are encouraged to consult a physician prior to engaging in any physical activity.

4. DESCRIPTION OF POSSIBLE ASSESSMENTS

Assessments may include, but are not limited to:

• Body weight, height, body fat estimations
• Circumference measurements
• Resting heart rate and blood pressure
• Postural analysis
• Joint range-of-motion evaluation
• Functional Movement Screen (FMS) or comparable assessments
• Strength, endurance, or power testing
• Cardiovascular and aerobic capacity tests
• Movement pattern evaluations
• Flexibility and mobility assessments
• Resting Metabolic Rate (RMR) testing

Specific preparation instructions (e.g., fasting before RMR tests) must be followed unless overridden by medical instruction.

5. PARTICIPANT DISCLOSURES (ADULTS & MINORS)

You must inform TGU if any of the following apply:

• Chest discomfort during exercise
• Irregular heartbeat or diagnosed heart condition
• Fainting, dizziness, seizures, or unexplained falls
• Bone, joint, or spinal conditions aggravated by activity
• Pregnancy
• Medical restrictions
• Use of medications affecting exercise tolerance
• Any condition that may affect safe participation

Failure to disclose relevant health information increases risk and is the participant's sole responsibility.

6. ASSUMPTION OF RISK (ADULTS & MINORS)

Physical activity inherently involves risks, including but not limited to:

• Muscle strains or tears
• Sprains or joint injuries
• Worsening of existing conditions
• Shortness of breath, dizziness, or fainting
• Irregular heartbeat
• Falls, accidents, equipment mishaps
• Serious injury
• Rare cases: cardiac events or death

By participating, the Participant (or Parent/Guardian for minors) voluntarily assumes all inherent risks associated with physical training and assessment.

7. NO GUARANTEE OF RESULTS

Turkish Get Up makes no promise or guarantee regarding:

• Weight loss
• Muscle gain
• Performance outcomes
• Pain reduction
• Physical transformations
• Skill improvement

Results vary individually based on numerous factors outside of TGU's control.

8. MEDICAL NON-ADVICE CLAUSE

TGU does not provide:

• Medical advice
• Physical therapy
• Chiropractic care
• Diagnosis of injury or illness
• Prescription guidance

Any information provided is for educational and fitness purposes only.

9. LIABILITY WAIVER & RELEASE OF CLAIMS (ADULT PARTICIPANTS)

To the fullest extent permitted by law, I (the Adult Participant) hereby waive, release, and discharge Turkish Get Up, its owners, trainers, contractors, employees, and representatives from any and all claims, demands, actions, or causes of action arising out of:

• My participation in any TGU activity or assessment
• My use of instructions, programs, or recommendations
• Ordinary negligence by Turkish Get Up

This waiver does not apply to gross negligence, willful misconduct, or unlawful acts.

10. MINOR WAIVER (FOR PARTICIPANTS UNDER 18)

I, the undersigned Parent or Legal Guardian, acknowledge that:

• I have the legal authority to consent for the minor.
• I understand the risks of physical activity for minors.
• I voluntarily allow my minor child to participate.

I hereby waive, release, and discharge Turkish Get Up from liability for injuries, harm, or damages arising from the minor's participation, to the extent allowed by California law.

California prohibits parents from waiving liability for a minor's gross negligence, but allows waivers for ordinary negligence. This waiver is written accordingly.

11. PARENT/GUARDIAN INDEMNIFICATION (REQUIRED IN CALIFORNIA)

I agree to indemnify and hold harmless Turkish Get Up from any claim brought by:

• The minor
• The minor's estate
• Any third party
• Another parent
• Relatives or representatives

arising out of the minor's participation, except for claims resulting from gross negligence or willful misconduct.

This indemnification includes attorneys' fees.

12. PHOTO, VIDEO, AND DATA RELEASE (OPTIONAL USE)

By participating, the Participant (or Parent/Guardian) grants permission to Turkish Get Up to collect, store, and use:

• Photos or videos submitted for form review
• Movement assessment data
• Training metrics
• Before/after images (only if voluntarily uploaded)

TGU will not publicly post or share identifiable content without additional explicit permission.

13. PRIVACY ACKNOWLEDGMENT (U.S. + CALIFORNIA CCPA)

By participating, you acknowledge:

• You have reviewed or been given access to the TGU Privacy Policy
• You understand your rights under the California Consumer Privacy Act (CCPA)
• TGU may process personal and fitness-related data as described
• You may request deletion, export, or modification of your data at any time

14. GOVERNING LAW

This Agreement is governed by the laws of the:

• State of California, and
• United States of America

regardless of conflict-of-law rules.

15. BINDING ARBITRATION AGREEMENT (ADULTS & PARENTS/GUARDIANS)

To the fullest extent permitted by law:

• Any dispute arising from participation in TGU services shall be resolved exclusively through binding arbitration.
• Arbitration shall be conducted in San Francisco County, California.
• Proceedings shall follow the rules of the American Arbitration Association (AAA).
• The decision of the arbitrator shall be final and enforceable.

This applies to both Adults and Parents/Guardians signing for minors.

16. CLASS ACTION WAIVER

The Participant (and Parent/Guardian for minors) agrees:

• No class actions
• No class arbitration
• No representative actions

Each participant must bring claims individually, not collectively.

17. ELECTRONIC SIGNATURE & ACCEPTANCE

By clicking "I Agree," entering initials, tapping consent, or completing account creation, you acknowledge that:

• Your electronic signature is legally binding
• You agree to all terms of this Agreement
• You have had the opportunity to ask questions
• You understand the risks
• You voluntarily consent

Under the U.S. E-SIGN Act and California Uniform Electronic Transactions Act, electronic acceptance carries full legal effect.

18. SEVERABILITY

If any provision of this Agreement is found invalid, all remaining sections remain fully enforceable.

19. ENTIRE AGREEMENT

This Agreement represents the entire understanding between you and Turkish Get Up and supersedes all prior oral or written agreements.
